By accessing or using anielak.net ("Company", "we", "us", or "our"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree, you may not use the services.
If you are using the services on behalf of an organization, you represent that you have authority to bind that entity.
You must be at least the age of majority in your jurisdiction to use the services. By using the services, you represent that you meet this requirement.
We provide a developer platform including authentication services, APIs, link management, QR generation, EDI/document parsing, and analytics tools.
We may modify or discontinue services at any time with reasonable notice.
You agree to provide accurate information and maintain account security. You are responsible for all activity under your account.
We may suspend accounts that pose security, legal, or operational risks.
Paid services are billed on a recurring basis. You authorize us to charge your payment method accordingly.
Fees are non-refundable except where required by law. Pricing changes will be communicated at least 30 days in advance.
You agree not to misuse the services, including:
We may enforce rate limits, suspend access, or terminate accounts for violations.
Use of APIs must comply with our documentation and rate limits. Excessive or abusive usage may result in throttling or suspension.
You may not resell or sublicense access to the services without authorization.
All platform content remains our property or that of licensors.
You retain ownership of your data. You grant us a limited license to process it solely to provide the services.
Your use of the services is governed by our Privacy Policy.
You acknowledge that data may be processed and stored in Canada and other jurisdictions. Where applicable, we implement safeguards for cross-border data transfers.
You agree to comply with applicable electronic communication laws, including Canadian anti-spam laws, when using our services.
We aim for high availability but do not guarantee uninterrupted service. Service levels may be governed by separate agreements.
THE SERVICES ARE PROVIDED "AS IS" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED. WE DISCLAIM ALL WARRANTIES INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICES WILL BE ERROR-FREE OR UNINTERRUPTED.
TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE ARE NOT LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING LOSS OF PROFITS, DATA, OR GOODWILL, ARISING OUT OF OR IN CONNECTION WITH THESE TERMS OR YOUR USE OF THE SERVICES.
OUR TOTAL LIABILITY IS LIMITED TO THE GREATER OF (A) FEES PAID IN THE PREVIOUS 12 MONTHS OR (B) $100 CAD.
SOME JURISDICTIONS DO NOT ALLOW LIMITATIONS OF LIABILITY, SO PARTS OF THIS CLAUSE MAY NOT APPLY.
YOU AGREE TO INDEMNIFY US AGAINST CLAIMS ARISING FROM YOUR USE OF THE SERVICES OR VIOLATION OF THESE TERMS.
We may suspend or terminate access at any time for violations or risk.
Upon termination, your right to use the services ceases immediately.
You agree to comply with applicable export control and sanctions laws. You may not use the services in prohibited jurisdictions.
These Terms are governed by the laws of British Columbia and applicable Canadian federal law.
If you are a consumer, mandatory laws of your jurisdiction may apply.
We may update these Terms with at least 30 days' notice for material changes.
These Terms constitute the entire agreement between you and the Company.
If any provision is found unenforceable, the remaining provisions remain in effect.
